TL;DR
B2B default; CPA/ECTA overlay for qualifying consumers. Quotes 30 days unless indicated; import-priced lines adjust if FX moves ±2% before payment (symmetric). Payment: ZAR; accounts 30 days EOM; non-account: upfront EFT/card. We may charge late interest up to the maximum lawful rate. Delivery: EXW JHB unless stated; SA 3–5 business days / exports 7–14 indicative. Risk on dispatch/collection; title on full payment. Returns: standard stock 10 business days; handling up to 15%; specials/custom/cut/electrical & electronic NCNR. Hydramatics-made goods: 3-month warranty; third-party goods: manufacturer warranty, we facilitate claims. If TL;DR conflicts with clauses, the clauses govern.
1. Application & Interpretation
Applies to goods (components, assemblies, spares) and services (workshop/repairs/light builds/consulting/training/commissioning), online or offline. “Hydramatics”, “we/us/our” = Hydramatics Control Equipment (Pty) Ltd. “Customer/you” = purchaser/recipient. Incoterms® 2020 apply.

5. Title, Risk & Retention
Risk passes on dispatch/collection or as per agreed Incoterm. Title passes only on full, cleared payment; until then we retain ownership and may recover goods on default.
6. Shipping, Delivery & Delay Relief
EXW by default; courier options on request/checkout. Indicative timelines: SA 3–5 business days; exports 7–14. Delay goodwill (at our discretion): if delivery is >5 business days beyond the latest estimate without prior notice, you may request either a refund of Hydramatics-charged shipping or a rebate of 1%/late day on affected lines (cap 10%). Exclusions: force majeure, strikes, load-shedding, port/courier congestion, customs holds, incomplete/incorrect info, non-payment, delays attributable to you. Inspect on receipt; report damage/shortage within 7 days; keep packaging. Insurance optional at your cost.

(Time-and-materials; access/permits/isolation your responsibility; <24h cancellation may incur call-out; handover via job card/report; issues within 7 days; workmanship warranty 3 months; misuse/out-of-spec/media contamination/third-party installation excluded; loan/demo kit remains our property and at your risk.)
9. Warranties & Manufacturer Pass-through
Hydramatics-made goods: 3-month warranty. Third-party goods (e.g., Camozzi, Hy-Lok): manufacturer warranty applies; we facilitate claims. Periods/procedures vary by product; proof of purchase and serials/batch codes may be required. Wear-and-tear, misuse, improper installation, unauthorised modification excluded.
10. Technical Advice & Compliance
Advice is guidance only. You are responsible for selection/integration and compliance (codes, pressure equipment, safety, media). Ensure correct filtration, lubrication (where applicable), and commissioning. Specs may update; equivalent/superior substitutions may be supplied if necessary.
11. Privacy, Security & Cookies (POPIA; ECTA)
12. Export Control & Ethics
Comply with export controls/sanctions; no diversion to prohibited end-uses/users. Anti-bribery/anti-corruption laws apply.
13. Liability
Aggregate liability limited to amounts paid for the affected goods/services in the preceding 12 months. No indirect/special/consequential loss (incl. lost profit/production/data) except where unlawful to exclude. Nothing limits liability where unlawful.
14. Force Majeure
No liability for failure/delay due to events beyond reasonable control (acts of God, fire, flood, pandemic, strikes, load-shedding, war, sanctions, port/courier disruptions, government action). We’ll notify and mitigate where reasonable.
15. Changes to these Terms
We may update; material changes: 7 days’ prior notice via email (where available) and a site banner. Continued ordering after the effective date constitutes acceptance.
16. Law & Jurisdiction
South African law. You consent (s45, Magistrates’ Courts Act 32 of 1944) to the Magistrates’ Court for recovery, without prejudice to our right to proceed in any competent High Court.
